• Aet'Ta'laaqo: the formal pronouncement and resultant state of suspension—freezing of conjugal relation (pronounced de facto separation) for terminating the Bond of Nikkah (de jure separation) is permissible only on two occasions in time-line of married life —

 زوجیت  کے تعلق  کا بندھن نکاح کو تحلیل کرنے کے ارادےسے باضابطہ فیصلہ اور اعلان  ازدواجی  زندگی  کے دوران  صرف دو بار کیا جا سکتا ہے ۔

بعدازاختتام مدت عدت  (سورۃ الطلاق۔۲)معاشرے کے مرجہ قاعدے کے مطابق  انہیں یا تودوبارہ بندھن نکاح میں لینا ہے(اگر خاوند نے معاملات کی اصلاح کا ارادہ ظاہر کر دیا ہے۔البقرۃ۔۲۲۸)وگرنہ انہیں (مطلقہ بیویاں)انتہائی   مناسب انداز میں جدا کر دینا ہے(دو اچھی شہرت کے گواہوں کی موجودگی میں سورۃ الطلاق۔۲)۔

• Take note, it is not permissible for you (the husbands) who terminate the Conjugal Bond that you might take back any moveable and immovable asset out of that which you had already given them [even if it is plenty of wealth-4:20; this legal injunction at times becomes problem for pusillanimous husbands who then might play tricks-4:20]

اور  ان اسباب دنیا میں سے کچھ بھی واپس لینا جو تم نے انہیں  دوران زوجیت  دیا تھاتم لوگوں(طلاق دینے والے خاوندوں) کے لئے حلال نہیں ہے۔

• The exception to the aforementioned injunction is for that particular couple who considered-apprehended that they both would not be able to maintain the limits of Allah the Exalted in continuing the Conjugal bond/Nikah.

یہ حکم نافذ العمل ہے ماسوائے ایسی صورتحال میں جب دونوں(خاوند بیوی)کو یہ خوف لاحق ہو جائے  کہ (رشتہ ازدواج میں بندھے رہتے ہوئے)دونوں اللہ تعالیٰ کی مقرر کردہ حدودکے پابند نہیں رہ سکیں گے۔

• Thereby, in such case if you people-society/concerned families apprehended that this couple will not be able to maintain the limits of Allah the Exalted, then there is not at all harm-blemish in adjudging upon such couple that the wife agreeably recompensed out of that which her husband had given to her to earn separation/termination of Marriage Bond. [This is for the dislike of wife to continue matrimonial bond with her husband. But husbands should not tease and harass their wives to take them to this point of asking separation on payment of recompense-4:19].

اور اگر تم لوگوں(خاندان کے بزرگ/متعلقہ عدالت)نے  خدشہ محسوس کیا کہ وہ دونوں(خاوند بیوی))اللہ تعالیٰ کی مقرر کردہ حدود کی پابندی نہیں کر سکیں گے تو اس میں قطعاً ان دونوں پر لینے دینے میں کوئی  قدغن نہیں  جواُس(طلاق لینے کی خواہشمند بیوی) نے باہمی رضامندی سے حصول طلاق کے لئے بطور فدیہ دیا۔

چونکہ طرز معاشرت کے یہ طے کردہ اصول ہیں اس لئے تمہیں چاہئے کہ ان سے دانستہ،زیر مقصد تجاوز نہ کرو۔

• Beware, whoever consciously and diligently transgresses the limits set by Allah the Exalted —

یاد رہے؛جس کسی نے دانستہ اورذاتی منفعت کے مقصد سے اللہ تعالیٰ کی مقرر کردہ معاشرتی حدود سے تجاوز کیا۔

• Thereby they are truly the evil-doers-distorters-creators of imbalances-disorders-over stepping.-- [2:229]

تو یہ ہیں وہ لوگ جو حقیقت کو باطل میں بدلنے والے ہیں۔

• [Reverting from parenthetic] Thereat, if the husband divorced her (the Wife who demanded and paid for the termination of Marriage), then She will persistently not be permissible in timeline for him (divorcing husband) after the earned divorce —

فدیہ دینے کی رضامندی پر اگر اس(خاوند) نے اسے(اپنی طلاق لینے کی آرزومند بیوی)بندھن نکاح سے الگ کر دیا ہے  تو اس کے بعد کے زمان میں وہ(بندھن نکاح سے آزاد کر دی گئی بیوی)اس مرد کے لئے حلال عورتوں میں شمار نہیں۔

• Until such time that she might marry with a spouse of her choice other than him who divorced her. [Now as a married woman she like all other men is also "har'aam"/prohibited for her earlier husband].

یہ صورتحال اس وقت تک برقرار رہے گی  یہان تک کہ وہ(بعوذ فدیہ آزاد کردہ عورت)اپنی مرضی سے ایک مرد سے نکاح کر لے جو اس(سابقہ خاوند)کے علاوہ ہے۔

• Subsequently, in case her husband had divorced her [either before intercourse as allowed hereafter in 2:236,237, or after matrimonial relations], thereat, there is not at all harm-blemish upon the two that they might mutually approach each other to remarry. This is however subject to the condition that they both felt that now might mutually maintain the limits set by Allah the Exalted.

اس نکاح کے بعد اگر(جب)اس (موجودہ خاوند) نے اس عورت کو(چھوئے یا بن چھوئے)بندھن نکاح سےآزاد کر دیا ہو تو اس نئی صورتحال میں ان دونوں(دوسرے خاوند کی مطلقہ اور اس کا پہلا خاوند)پر ایک دوسرے سے نکاح کے لئے رجوع کرنے میں قطعاً حرج نہیں بشرطیکہ  دونوں اس مرتبہ اللہ تعالیٰ کی مقرر کردہ حدود کی پابندی کر سکیں گے۔
