لزاء والنون والحرف المعتل لا تتضايف، ولا قياس فيها لواحدةٍ على أخرى. فالأوَّل الزِّنَى، معروف.
ويقال إنّه يمدّ ويقصر

That it is well known, illicit intercourse, prolong and short mounting.

Lane Lexicon: He committed fornication or adultery; (El-Munáwee, Er-Rághib, TA;) بِهَا with her: (MA:) but accord. to El-Munáwee, [it seems to be properly a dial. var. of زَنَأَ as meaning he mounted; for he says that,] in the proper language of the Arabs, الزِّنَا signifies the mounting upon a thing; and in the language of the law it signifies the commission of the act first mentioned above: 

Zina (زنا)  Arabic signifies illegal intercourse; premarital or extramarital.

Adultery (also called philandery, anglicized from Latin adulterium) is voluntary sexual intercourse between a married person and someone other than the lawful spouse. Religious and legal interpretations of what constitutes adultery vary widely.

Fornication typically refers to consensual sexual intercourse between two people not married to each other

The act in both cases is the same, and it is "Intercourse involving male and female genitals". The categorization in legal enactments of some societies is by the Subjects to whom the male genitalia and female genitalia belonged doing intercourse. Act remains the same in both cases.

الزِّنَى It is a Verbal Noun signifying an action and a state only. It only denotes the act of intercourse and a state where the male genitalia intercourses with female genitalia. It does not refer to the doer of act as to who are they who are performing intercourse.

The woman performing in the act of intercourse is Active Participle الزَّانِيَةُ
and the man performing in the act of intercourse is also Active Participle  الزَّانِي . The definite Active Participles refer to that man and woman who have been convicted guilty of being the Performers of that act which is denoted by its Verbal Noun الزِّنَى i.e. sexual intercourse. It has no reference to the marital status of convicts at the time of performance of the act الزَّانِي.

At the very place of its use, it is made explicit that it relates to only mutually consented intercourse which is approached by desire of nearness. It does not include Rape, be the vicitm a man or woman.


  • And you people should not approach nearing the mutually consented sexual intercourse

  • Indeed this act has ever been an immoderation and sinful as a course. [17:32]


  • The woman and the man held guilty of charge of consented illicit sexual-intercourse by the competent court of law: thereby, you the state-executive authority are directed to flog each of them two; the manner of execution is flogging one hundred times, the object being restricted to the skin: not excoriation.

  • And softness of heart - feeling of sympathy for both of them should not seize you people in executing the Code of Conduct prescribed by Allah the Exalted, if you were truly believing in Allah the Exalted and the Last Day.

  • And a group of believers should observe the punishment of both of them. [24:02]


  • The Man convicted [by the competent court of law] of consented illicit sexual-intercourse shall not henceforth enter into the contract of Nikah: matrimonial bondage except with a woman-convict of illicit sexual intercourse or a polytheist woman.

  • And no one except a convict-man of illicit sexual intercourse or a polytheist shall marry certain woman convicted of consented illicit sexual-intercourse.

  • And this marriage: entering into Nikah with the man or the woman convicted of illicit sexual intercourse is prohibited for the Believers. [24:03]


  • And they are those who never call besides Allah the Exalted any other as iela'aha; godhead

  • And nor they executeaward capital punishment to a person; whom Allah the Exalted has granted sanctity and protection, except on chargeconviction of rightful allegation; [as envisaged in 5:32-33].

  • And they do not indulge in consented illicit consented sexual-intercourse

  • Take note, whoever indulges in illicit consented sexual-intercourse, he will meet/face dilapidation [25:68]


  • O you the Elevated and Chosen One [Muhammad Sal'lallaa'hoalaih'wa'salam]

  • When believing women have arrived/migrated to you making themselves solemnly pledge before you to the effect that they will not associate with Allah anything

  • And nor they will steal, and nor they will indulge in consented sexual intercourse and nor they will kill their offspring

  • And nor they will allege false allegations forging it with reference to between/middle of their hands and middle of their feet/legs

  • And nor will refuse your word in the known and accepted norms of society

  • Thereupon/as a result you accept their fealty [in exchange of promise of award of Paradise] and for these women seek forgiveness from Allah the Exalted.

  • It is a fact that Allah the Exalted is repeatedly Forgiving-Overlooking-the fountain of Mercy.  [60:12]

  • یقینا اللہ تعالیٰ  درگزر اور پردہ پوشی کرنے اور معاف فرمانے والے ہیں، منبع رحمت ہیں۔
